E-mailIn a victory for tyranny and injustice, a federal appeals court ruled the president has the power to arrest American citizens and imprison them indefinitely without charging them — at whim.
Judges of the U.S. Fourth Circuit Court of Appeals in Richmond, Virginia, in a 5-4 decision, ruled that the president can legally, by simply labeling an individual an “enemy combatant,” imprison anyone, citizen or not, without due process for months, years, decades — or indefinitely.
The Fourth Circuit Court of Appeals reversed an earlier three-judge panel’s decision which ruled that the government lacked the power to detain Ali al-Marri, a citizen of Qatar legally in the United States on a student visa, who had been charged with credit card fraud and making false statements as part of the 9/11 investigation. Keep in mind the Bush administration is not accusing al-Marri of having any connections to al-Qaeda or the Taliban or fighting against U.S. forces. He is accused of being involved in an unproven terrorist plot, which he denies.
That didn’t stop the judge who was the swing vote in the matter, William Traxler, from opinionating in the ruling (page 28):
As pointed out by my colleagues, the Constitution generally affords all persons detained by the government the right to be charged and tried in a criminal proceeding for suspected wrongdoing, and it prohibits the government from subjecting individuals arrested inside the United States to military detention unless they fall within certain narrow exceptions. See United States v. Salerno, 481 U.S. 739, 755 (1978) (“In our society liberty is the norm, and detention prior to trial or without trial is the carefully limited exception.”) The detention of enemy combatants during military hostilities, however, is such an exception. If properly designated an enemy combatant pursuant to legal authority of the President, such persons may be detained without charge or criminal proceedings “for the duration of the relevant hostilities.” Hamdi v. Rumsfeld, 542 U.S. 507, 519-521 (2004).
Judge Traxler’s attitude toward vesting the president with extensive tyrannical powers is astounding as is his understanding and interpretation of the law. He continued with an even scarier statement [Dec. at 62]:
The President has cautioned us that “[t]he war on terror we fight today is a generational struggle that will continue long after you and I have turned our duties over to others.” –Pres. George W. Bush, State of the Union Address (Jan. 23, 2007). Unlike detention for the duration of a traditional armed conflict between nations, detention for the length of a “war on terror” has no bounds.
And the scariest of all, this opinion [Dec. at 98]:
Under the current state of our precedents, it is likely that the constitutional rights our court determines exist, or do not exist, for al-Marri will apply equally to our own citizens under like circumstances. This means simply that protections we declare to be unavailable under the Constitution to al-Marri might likewise be unavailable to American citizens, and those rights which protect him will protect us as well.
The Fourth Circuit Court of Appeals is therefore advocating a circumvention of basic constitutional rights by the president of the United States and the courts. And this power, once invested will carry forward to all subsequent presidents and courts. They have determined that they will be the “deciders,” specifying who will and who will not be afforded due process under constitutional law.
Glenn Greenwald of Salon has a great analysis of the case and says it better than anyone:
At least with regard to individuals detained on U.S. soil, the Bush administration has exercised these definitively tyrannical powers in only a handful of cases -- two U.S. citizens (Hamdi and Padilla) and one non-citizen in the U.S. legally (al-Marri). But what the administration has done is asserted those powers generally, and embarked upon a strategy to ensure that they are institutionalized. Yesterday's ruling -- likely (though not certain) to be reviewed by the U.S. Supreme Court -- is but another step down the path of un-American radicalism we've been traversing.
Greenwald points out our Founding Fathers warned against investing a president with such powers: “The very core of liberty secured by our Anglo-Saxon system of separated powers has been freedom from indefinite imprisonment at the will of the Executive,” something they were only too familiar with.
“George Bush will likely leave office with this particular tyrannical power infrequently exercised but nonetheless vigorously asserted, defended, and close to established,” Greenwald says. “This is yet another step in the creeping extremism of the last seven years — like torture and warrantless eavesdropping, this power (allowing the President to imprison U.S. citizens in military brigs with no charges) is one that was until quite recently inconceivable, but is now a defining part of how our Government operates.”
The mournful tolling of a funeral bell can already be heard as it sounds the approaching death of freedom -- that is unless the American people demand that Congress reign in the creeping totalitarianism that is rapidly destroying our once free republic.
My own son, ex-military, agrees with the President. I'm afraid most of our younger generation is blind/deaf/IGNORANT of what is going on here and how NON-AMERICAN it is.
But there are others who have given up;I have had a few people tell me THEY ARE LEAVING THIS COUNTRY.
Words are not enough.

There is hope, and it is in the forthcoming generation. But please get your kids out of the useless government schools, and lets start educating properly, the way Thomas Jefferson and the like were educated.
Lets train leaders, statesmen, men and woman who will stand up for liberty and inspire greatness in others. We must be proactive.

Ultimately he was saying that the service (military) must be mandatory, that "people of all ages, genders and races and social groups will be given an opportunity to serve" and this is the only way that this nation will become united. Etc, etc.
He was going on and on, and so children will have to serve and... In fact, his primary accent in the speech looked like was on Children Service! Well, it is very disturbing, indeed.
So ultimately, this Executive Order is a good match. A neighbor reports a neighbor, a kid reports a sibling... and then the SWAT come in and take someone away. In the morning you look around, and can't see one or the other of your neighbors, call your friends, and they don't pick up the phone... It is not any Hollywood-staged fiction, it was the-the reality of a few generations in Europe.

This kind of war is different than the war our forefathers fought against a clearly identified enemy- the "redcoats." Today our enemy doesn't wear a uniform which makes the educational route the only alternative choice we have of attaining victory against an enemy that is vulnerabe to exposure. Today our enemies have objectives except that today's enemies don't tote muskets and pull around canons like the redcoats did under British general Cornwallis. There are a number of low profile and high profile groups out there in large numbers. They are trying to do the same thing. But it's not working. The current Government has pushed things on us that come straight out of fiction and have gotten away with it. I remember all the steam generated by the Patriot Act, the Real ID Act, even the steam and anger generated by the Supreme Court ruling of Kelo vs New London. All of this was imposed upon the People years ago, and for all the groups that formed to fight them and reverse the trend, how many have succeeded?

History has proven time and again that restoring Freedom once snatched away has never, ever been done peacefully. In 2010, the SPP will be pushed live. The North American Union has been brought into the light, people are more aware of it, the SuperHighway may have gotten exposed and stopped, but guess what? Their web site isn't closed, they are still holding their meetings and the SPP is still being negotiated behind our backs between Canada and Mexico. How is this stopping it?
The point is more than academic. The current system is designed to give you a lie, to keep folks into thinking they are making a difference when all that is fixed and restored is a sum of zero. How many more years as we willing to lose to more Unconstitutional Laws and the stripping of freedom?
I say we excersize the Preamble of the Declaration of Independence. No, the bad people aren't marching around with muskets. They send Federalized national Guardsmen via a little known clause in the Military Commissions Act, the FBI and private firms like Blackwater with automatic weapons and they take what they want. Remember the Catrina Gun Confiscations? Who stopped them? How did they get away with it? And now we have a law passed barring it from happening again, why then didn't the Constitution prevent it since that was all ready on the books? Simple answer. Laws aren't effective unless enforced. When the establishment only enforces the laws they pick and choose to get us, the People to do what they want, we aren't free anymore.
I'm willing to die to help restore freedom, and I know I'm not the only one who feels that way. I'm also willing to excercise the authority for it under the 10th Amendment in the Bill of Rights, and the 14th Amendment Section 1. Please read the Preamble of the Delaration of Independence. You'll see it fits today like a frighteningly accurate glove. These things have come to pass, and more than prudence has been granted and excersized. I say enough is enough. Their games need to be over and we need to be put back in charge of our country.

Our government is broken, its goodness has been twisted by
those who wish to destroy it and subtly impose new restraints upon
us. Our Constitutional republic requires some serious repair time,
and new safeguards to protect our future liberties.

The objective here is just this:
1. Shut down portions of the government at designated times.
2. Honorably dismiss "all" the officials from office in mass, both
the good and bad, in a non-partisan manner. The purpose is to achieve
a fresh start and remove all that is broken at its root. Sadly, but it is
necessary, to remove even the good officials to root out the bad.
3. Hold formal public elections to select good, upright and responsible citizens
for office.
4. Fix what's broken, i.e. audit all laws, taxation.
5. Start up the government branch or department anew.
6. Swear in the new representatives.
7. Move on to repair the next government level, beginning at the top office(s)

The Millennium Amendments
to the
Bill of Rights
of
The United States of America
Preamble:
We, the people of the United States of America, In order to further preserve our freedoms and our Constitutional Republic, do also declare that, entities, within our government have covertly subverted, changed our laws to meet with their own ends and have imposed values, foreign to our way of life.
They have attacked the very foundations of our faith that this country was founded upon and have persecuted our beliefs. They have legislated away the moral foundations from which the laws of this land were originally enacted.
They have defiled the highest offices in the land without shame.
They openly and shamelessly have lied to the American People and have squandered our country's wealth.
They have driven our businesses from our shores through excessive taxation and have openly invited foreign competition to our financial downfall.
They have allowed American job skills to be done on foreign shores by foreign workers and have devalued our standard of living.
They have denied us access to our national resources while inviting foreign products to overwhelm our markets.
They have encouraged the lowering of the standards of education in our schools and have interfered with the moral upbringing of our children with destructive legislation and belligerence.
They have corrupted our voting ballots with the registration of non-citizens and have not protected us from the relentless invasion of foreign nationals.
They have denied us access to our industrial energy needs and harmed our ability to get to and from our jobs. They have knowingly created false environmental claims to block our access to our country's resources.
They have denied us access to our massive oil reserves while purchasing oil at hyper inflated prices from foreign entities.
They have allowed foreign nationals to openly steal our nation's secrets and patents.
They have sold vital national defense technology to our enemies.
They have covertly taken illegal political campaign contributions from foreign countries who publicly have sworn themselves to our destruction.
These and countless other offenses against the citizens of The United States of America do summarize our discontent and do warrant corrective action to return law, order, and stability to our Constitutional Republic.
We The People of the United States do therefore add these amendments to The Bill of Rights, a provision given to us by our founding fathers. It is our right and duty, to correct and improve our government, and to provide new safeguards for our future security.
We, the people of the United States of America, shall continue to have the unconditional right to make and add amendments to the Constitution of the United States of America. This can and shall be done independently of the the three branches of The United States Federal Government, or the individual state governments of The United States of America.
Therein, none shall interfere with the peoples right to act according to their conscience and careful forethought to protect our Constitution from all enemies of our freedom, be they foreign or domestic. This shall be done independently of The Federal or State Governments of the United States or Constitutional Convention.
These amendments shall further guarantee the right of the Citizens of the United States of American to correct or prevent the alteration to the words and intent of all Amendments in the Constitution, that through the process of time, may take on meanings different than the original intent of the authors of this document.

Congress shall not abridge these rights nor any held by the People.
To prevent destructive divisions and corruption in the United States Congress that have led to a functional loss of representation, the people of the United States of America, shall, honorably retire all members of Congress after every seven presidential administration cycles or as may become necessary to maintain a just and fair government.
On the 15th day of December, in the year 2008, the people shall hold a special election to elect new members of The House of Representatives. On 15th day
of January, in the year 2009, the new House of Representatives shall be publicly sworn into office by the Chief Justice of the Supreme Court of the United States of America.
On the 15th day of March, in the year 2009, the people shall hold a special election to elect new members of the United States Senate. On the 15th day of April, in the year 2009, the new United States Senate shall be publicly sworn into office by the Chief Justice of the Supreme Court of the United States of America.
Thereafter:
The House of Representatives shall be honorably retired on even numbered years on or following the Presidential Election. The Senate shall be honorably retired on odd numbered years on or following a presidential election.
The people, thereby shall peaceably hold elections and shall nominate new individuals who are of good moral character and are devoid of all wrongful influences of previous elected and appointed officials or foreign entities.
The people, every 25th year on July the 4th shall elect new members to the Supreme Court in a national election. This amendment shall remove all judicial appointments made by the President and the Congress. This shall also provide for fair and impartial judicial interpretations of the laws of the People, devoid of political bias, governmental disruption, and potential corruption.
All unexpected vacancies in the Supreme Court of the United States, they by retirement, health or other reasons, shall be filled by a special election of the people.
No government official shall at anytime accept bribery, money, favor, or influence from any foreign government or individuals designed to influence the outcome of any State or Federal laws or elections. Any official found guilty, shall be guilty of treason, face immediate expulsion from office and
imprisonment.
All Non-governmental agencies, special interest groups, or individuals, shall not privately petition any member of the United States government. All petitions shall be in an open public forum for debate and shall be freely available in public record
Congress shall not permit the export of American Jobs to other countries.
Congress shall not excessively tax American businesses or Citizens so as to create an unfair hardship.
Congress shall not tax citizens individually but shall tax the states directly on a per-capita basis. States shall have the right to protest excessive taxation by Senatorial debate in the United State Congress.
Congress shall proportionally tax all imports of foreign products to match the
equivalent manufacturing costs of products in the American economy.
Congress shall not allow economic hardship to fall upon American business by foreign competition.
Congress shall discourage Free Trade and encourage Fair Trade.
Congress shall not deny the American People access to their national
resources.
Congress shall not enact laws to discourage the American People from
constructively using their national resources.
Congress shall provide access to the American people to their resources
in such a way that will not harm other resources or property.
Congress nor any government employee shall not profit from any act or
legislation during or seven years following their term of office or
civil service employment. Violations shall be a felony and shall be punished
by imprisonment.

All persons, not having achieved legal status in the United States of America,
having given birth to a child, the child shall be granted immediate guest status
of the embassy and full citizenship of the parent's native land.
The United States shall give temporary diplomatic treatment to all
undocumented guests from foreign countries and they shall be delivered to their country's embassy for safe return to their native land. All undocumented
guests may appeal their return, one time only, should they face persecution
or endangerment. A court of law may, at its discretion, extend documented
status to undocumented foreign guests.
All undocumented aliens, who have participated in criminal activity against the people or property in the United States of America, shall face punishment, deportation, and permanent denial of re-entry into the United States.
Upon the second violation, criminal aliens shall face permanent incarceration.
All undocumented aliens shall not be entitled to the rights and privileges
of citizenship in the United States of America. They shall instead be treated humanely and fairly until they can be returned to their country of origin.
All documented aliens applying for citizenship shall enjoy rights and
privileges of citizenship as may be provided by law.

The United States of America shall be a sovereign nation and shall protect its citizens, laws, land, and interests before all other considerations. Any laws to the contrary shall be considered null and void unless voted upon and passed by a 7/8 vote of the nation and enacted into law.
The issue here isn't what the people want and who should just "take action", I promise. The current establishment won't relinquish power and simply walk away. We have a system that is giving orders to the authorities and regardless of the authority and their own oath of office, they are acting on and performing unconstitutional and illegal orders. Google 'free speech zones' to see exactly what I mean.
The Millennium Amendments won't be necessary. What the average everyday American needs to know is that if their chain of command to their represenatives is broken, which it is big time, then they, the people themselves, have the authority to remove their represenatives from office, given sufficient proof that every system available to the people via impeachment and/or election system is compromised and doesn't allow due process to the constituents.
The weakest branch of the Government as designed by the founders is the Judicial. They are not supposed to legislate laws from their benches, and they are supposed to uphold the constitution. Our Supreme Court is failing that miserably, and by the majority to boot. They aren't fit to wear their robes let alone swear in anybody new.
Holding Office without consequences for violation of Oath of Office is exactly what we have going on today. There is no recourse with mounting evidence of vote tampering even in the last set of primaries. We wouldn't have any of these horrific issues if they would have simply enforced the Constitution we have. They failed to do that to the loss of freedom for every American who lives now, and every American who is going to be born from here on out unless we take our country back through enforcement of our own rights to correct the establishment.
Failure on our part to do so means we deserve the police state we live in now, while writing articles and giving speeches on how wrong it is while the establishment continues their usurpations of our liberties while enforcing their own self serving agendas.
I understand what you are saying about free speech zones and
at first glance, it is intimidating and frightening. Yes, you are most likely correct
in stating,
“ The current establishment won't relinquish power and simply walk away”
For this very reason, the problem must be corrected peacefully now, and
not violently, later.
I want America to realize the power that it has, and what the politicians
have kept from us. Washington has no right telling us "No!" Politicians
have no power over us, unless we permit it, but we've let it go on too long.
The corruption is very deep and has to be pulled out by the roots.
The ongoing problem has been documented over and over by the John Birch Society
over the years and fills our radio airwaves with chatter 7 days a week.
It took 200 years for corrupt individuals to undermine our present government. It is time to
shut down and peacefully repair what we have, before it results in civil war and bloodshed.
Human nature has changed very little, if at all. It's the same today
as it was 200 years ago during our War For Independence, or 800 years ago
during the Scottish Wars for Independence. People wait till things get out of hand
before they attempt to constructively correct assaults on their freedom.
The first step to our freedom is at the ballot box. Our government
is so very corrupt, that to weed out only a handful of corrupt politicians
is an exercise in futility. The damage is too extensive as you have pointed out.
I want everyone to take note, I said the ballot box. We must peaceably assemble,
define our grievances, peacefully assemble the public, and request a public election.
I appeal before all American Citizens to assist me in the authorship of the
Millennium Amendments. I ask for the wisest and the best minds who love this
country and its Constitution to take the forefront.
This is why I'm appealing to the John Birch Society and other stable Constitutionalists
and groups.
I'm going to try, with your help , to buy us another 200 years of freedom if I can.
When you have a million voters who demand something, politicians set up and take notice.
When you have several million citizens who demand reform, politicians start cleaning up their act and polishing their halo especially when they realize that a special Constitutional election might not be in their favor.
Even if I fail, it might be enough to put our country back on track.

The strongest branch of all is the people of the United States of America.
"We, the people" as written in the Constitution does not apply to the other three branches,

A handful of people built this nation. An army of people who wanted their freedom followed them.
And some just came along for the ride, while others joined the other side.

I am running as an Independent candidate for President, but I do not have millions of dollars for advertisement, and who cares what I stand for, the citizens of this country are so tired of the bull that candidates spout, and we know they are lying, but still we are convinced that only Tweedle Dee and Tweedle Dumb are possible to be elected.
I am one person, living on Social Security, even struggling financially where I can't travel the nation to get attention, can't afford TV advertising, and it is eating my heart out to see the treason happening in our nation to destroy us.
Our Veterans get propaganda telling then they are doing great, at great risk and when they come back to home, they are abandoned with all the financial loss they've experienced in their civilian life. Our government tells them to just go home and shut up. Our National Guard did not sign up for extended tours of duty, but expected 30day assignments at most, and for more local placements.
While they may look well trained because of the Uniforms they wear, and are outfitted, in reality they die just as easy as any other soldier in the past.
Going to Police action events instead of all out WAR that we must win, our military are sitting ducks. I want this stopped and if Iraq or Iran or any other nation is a risk to our security, then a war to win is the only way, and to not take all day to do it either.
WE must stop this Security and Prosperity Partnership crap, and the NAFTA Superhighway to Kansas City, and many other downsizing of America projects designed to destroy our nation.
I want our citizens to have the right to own all weapons to protect our sovereignty, to protect our Constitution, and Bill of Rights. The Bill of Rights Second Amendment was not written to allow citizens to keep hunting rifles, but to protect us from an out of control government that we now have. Terrorism in America? Review the ATF attack on the Dividian Building in Waco, TX, attacked based upon the fact that they had GUNS. Well the Second Amendment didn't specify how many guns or what kind of GUNS, it said the right of the people to own guns shall not be denied, and for a reason. To protect us from the government we have now.
We are losing our property rights, our rights to a trial if arrested, not this detained crap, our rights to not be searched, our rights to Free Speech, and our rights to continue to be a sovereign nation with borders protected.
I will return jobs to America, I will control the imports to our nation, I will control our borders and stop the drugs if we have to invade Columbia, and Mexico to do so. I will give no sympathy to any drug smuggler, whether CIA, or foreigner trying to bring drugs in to our nation.

Well I live in an infested Hispanic area of Los Angeles County, CA.
I'm tired of our wishy washy do nothing Congress and Senate. Whom we pay $14,000/month, every month, and they have no plan to end our financial crisis about fuel prices.
I got news today that our local Edison electrical supplier is raising electrical rates 35% in 2009, another 34% in 2010, and an additional 8% in 2011. Based upon the raise in price of Natural Gas, which is not imported from OPEC, but right out of our ground in the good old United States of America. Well my Natural Gas cost has gone up 400% since 1971 based upon OPEC, not on cost of acquiring the gas, and distribution.
We are being screwed, by the same Oil companies that have been burning off the excess Natural Gas at the well head the last 60 years.
Americans rise up and Revolt, Vote, this November, vote for an Independent, break the cycle of Republicans or Democrats that will continue to end the sovereignty of our nation.

I come from a town of about 300,000 people here in California. My city is beginning to look like a ghost town as more and more cars are leaving the streets. Food prices here are starting to go through the roof. Business's are closing right and left. They've been here for years. People here are having to choose between medical treatment and filling their gas tank. Unemployment is growing and growing.

In our Congress, in Washington DC, the Speaker of the House of Representatives, Nancy Pelosi, is sitting on our Oil Wells and refusing to let us, the American People of all 50 States of the United States of America, access to once single drop of oil. Our economy is failing and is rapidly approaching collapse. She and her Anti-American Congressional Representatives and Senatorial followers including my Senator (see proof below) do not care whether we live or die. They do not love this country, or anything that it stands for. Do not believe me! Look for yourself!

My Senator's letter:
Thank you for writing to me to express your support for increasing domestic oil and gas exploration. I appreciate hearing from you on this important energy issue, and I welcome the opportunity to respond.
I share your concern that rising energy prices are placing a burden on American families and agree that it is important for the United States to continue to develop its oil and gas resources in concert with our efforts to reduce demand. I do not believe, however, that the United States can drill our way out of these record energy prices. According to the Department of Energy (DOE):
The United States consumes more than 20.5 million barrels of oil per day - or 25 percent of total global consumption - but has less than three percent of the known global reserves;
Opening the Arctic National Wildlife Refuge (ANWR) to oil and gas exploration would not increase domestic crude oil production until 2018;
Additional oil production from opening ANWR is estimated to yield 745,000 barrels per day - or 3.6 percent of daily U.S. consumption - and would reduce the price of oil by no more than $1.44 per barrel; and
Lifting the Federal moratorium on the Outer Continental Shelf (OCS) would not have a significant impact on domestic crude oil and natural gas production or prices before 2030.
You may also be interested to know that between 1999 and 2007, the number of drilling permits issued to the oil industry increased by 361 percent. Over the same period, however, gas prices increased from $1.25 per gallon to over $4.00 per gallon. The oil industry also has access to significant oil and gas resources on federal lands and waters that they have yet to use. According to the Department of the Interior:
The majority of crude oil and natural gas believed to be available on the OCS - 79 percent of oil and 82 percent of natural gas - are already available for drilling through existing leases; and
Nearly 64 million acres of federal land and water leased to the oil and gas industry are not being used to increase domestic production.
Instead of initiating oil and gas exploration in places like ANWR and the OCS, I believe that the United States needs a long-term strategy to address our dependence on oil. We must take steps to increase the use of renewable energy and maximize current supplies by supporting energy efficient technologies. Please know that I appreciate hearing your support for increasing domestic oil and gas exploration, and I will keep your thoughts in mind as I continue working with my Senate colleagues to strengthen our national energy policy.
